These General Conditions ( General Conditions ):

Unless expressly provided otherwise, any improvement of one or more existing services or any new service promoted by Jopla will be subject to the following General Conditions.

These General Conditions may be updated or modified by Jopla; changes and additions will be valid and effective from the date on which they will be communicated by publication on the site or on the App and will apply from that date.

Account / Profile: is the User’s profile in order to obtain full access to use the Website and the App.

App Jopla : these are the Jopla applications – web or mobile – Jopla For You and Jopla Pro.

Committee / Client : is the applicant for occasional work – Private (natural person) or Company (legal person).

Jopla For You: is the Profile Management App for the Client.

Jopla Pro: is the Profile Management App for the Professional.

Jopla.it: is Jopla’s website.

User / User: the owner of the Profile – Professional or Client.

OBJECT

ART. 1 – Description of Jopla services

Jopla offers various Services to help its Users find, coordinate and maintain quality independent professional relationships.

  • publish requests and job advertisements on the Site and thus facilitate the search for professionals suited to your needs;
  • the use of the Jopla Pro platform for people who offer professional services in various sectors (such as individual or shared childcare, elderly care, special needs, pet care, cleaning services, gardening, maintenance, etc …), which allows to search, select, restrict, locate, find and communicate with those looking for such services, to publish offers and job advertisements on the Site and thus facilitate the search for customers suited to their needs;
  • a dedicated section to companies that want to improve employee welfare by giving them access to Jopla services according to the rules and indications governed in the Welfare Policy published on the Site;
  • the use of tools and information ions to help both applicants and professionals to make more informed decisions and to forge suitable and safe professional relationships, such as (i) identifying the right contract between client and professional, (ii) providing adequate insurance coverage to work safely, (iii) the easy and secure organization of all business appointments, and (iv) a process for identifying the right compensation;
  • access to an authoritative and open review platform to all its users on which it is possible to read the experiences of others, share their own and enter into dialogue with Pros and Customers, according to the rules and indications governed in the Reviews < strong> Policy published on the Site;
  • access to the online Loyalty Program for registered Users which allows, based on the use of the services and the Platform, to obtain Loyalty Rewards and / or Points according to the rules and l and indications governed in the Fidelity Policy published on the Site;
  • access to the Program Invite your friends online for registered Users which allows to obtain Rewards and / or Points according to the rules and indications governed in the Friends Policy published on the Site;
  • the use through Stripe Inc., (“Stripe “), of the service that facilitates payment and direct crediting of services by credit or debit card [1] ;

ART. 2 – Limitations of Jopla services

Jopla offers services to connect Users and help and assist them in this context, that is, to seek, find, coordinate and maintain professional relationships.

However, Jopla:

  • does not employ or contract any professional or service provider and is not responsible for the conduct, online or offline, of any person in relation to employment relationships and professional collaboration, or other user of the site or services. All Users are responsible for compliance with all applicable labor and other laws in relation to any employment relationship they establish (such as applicable laws relating to employment, working hours and organization, fiscal and tax compliance , on the principles of equal opportunities and non-discrimination, on fair and minimum remuneration,);
    • Jopla does not assume the contractual responsibility of the Client towards the Professional and vice versa of the Professional towards the Client;
    • the content of the Services is mainly generated by users. Jopla does not control the accuracy of the content generated by users and does not assume and expressly disclaims any responsibility for the accuracy or reliability of any information provided by users on or off the site, does not assume and expressly disclaims any liability. that may derive from the use of the information provided on the site;
    • Jopla does not refer or recommend seekers or professional service providers, nor does it make any declaration about its suitability, the reliability, timeliness or accuracy of the services provided by professionals or the integrity, accountability or actions of seekers or professional service providers whether in public, private or offline interactions;
    • any control of a User and his information by Jopla is limited and should not be regarded as complete, accurate, current or conclusive of the suitability of the individual or ‘entity as an employee or principal;
    • Jopla is not an employment agency and does not insure or procure employees for applicants, nor does it ensure or procure employment opportunities for professionals;
    • does not control, monitor, or supervise the quality, timing, schedule, pay, legality or any other aspect of the services provided, nor require professionals to accept or work or provide services to anyone;
    • does not provide any medical, diagnostic, therapeutic or clinical services or engage in any conduct that requires a professional license;
      • offers Registered Users the opportunity to verify certain information such as e-mail address, mobile number, identity documents or, where necessary, information on licenses and / or certifications. If it indicates that certain information has been verified, it means that you have followed the established process for verifying that information. However, Jopla cannot guarantee, nor represent, that the information is accurate or that it belongs to the Registered User who provided it;

ART. 3 – Exclusions

Any connection or contact between the Professional and the Client that involves the establishment of an employment contract is excluded and unavailable through the Jopla Services. If, based on the research carried out or the needs of the Users, the need, preference or establishment of a subordinate employment relationship is identified, it will not be possible to use the Jopla Services, and the Users will have to address and contact the entities independently. competent.

The following services are excluded and can be activated at the request of the Pro or the Customer through the contact functionality with Partners external to Jopla on the Site or the App:

  • preparation of tax returns and electronic transmission to the competent agencies

CONDITIONS OF USE OF THE SITE AND THE JOPLA APP

ART. 5 – Licence to use Jopla software

Through the General Conditions indicated below, the contractual relationship between Jopla (hereinafter, even for the sake of brevity, referred to as “Property”), as owner of the site www.jopla.it, of the usable software is defined and regulated. , as well as the application called “Jopla” and the Users (hereinafter referred to as the “User” for the sake of brevity).

The Property grants the User a limited, non-exclusive, non-transferable and non-sub-licensable license to access the Jopla Services and make personal and commercial use thereof, limited to the professional activity exercised.

The systems listed are based on software developed directly by the same proprietary company and are accessible 24/24, 7 days a week.

The User will have a wide range of products and services dedicated to combining professionals and customers in the most compatible and simple way, minimizing the environmental impact, aimed at Professionals, Families, Consumers and Companies.

These products and services concern in particular:

  • the possibility for each client to easily find the right candidate, through recommendations deriving from quality assessments, skills and previous combinations;
  • the possibility for professionals to create their own personal brand online for free, work with trusted customers and create a network;
  • the digital capacity capable of creating Client / Pro combinations that minimize the CO2 emissions of business travel, and subsequently offers a simple tool to compensate for them;
  • online administration (calendar, messages, payments, contract, insurance), so that users can go on with their lives

This license does not include any right of resale or commercial use of each Jopla Service or its contents, nor the right to collect and use product listings, descriptions or prices, make derivative use of the Jopla Services or their contents, make any kind of to download or copy account information for the benefit of another reseller or use data mining, robots, or similar data capture and extraction devices.

The Jopla For You service allows the Customer to search for professionals also for any company / s of which he is the legal representative for internal use only, in addition to personal and family research.

In this case, it is expressly forbidden to use the Jopla For You Services for recruiting research on behalf of third parties. All rights not expressly conferred by these General Conditions remain with Jopla or its licensors, suppliers, publishers, owners or other service providers.

ART.6 – How to use

To access the Company’s sites and use the Company’s Software for the creation of the Profile and the use of the Services, the User must have access to the Internet (any costs and connection costs are exclusively for charged to the User) and the necessary equipment (computer, mobile device, smartphone modem or any other connection tool) to allow him to download the App, as well as data, files and digital photographs.

The User (professional) can use the Jopla Pro App only on a mobile device and will be able to access the Jopla Pro App and the dedicated services by downloading the application for free from iTunes (iOS version), from the Google Store (version Android).

The User (customer) can use the Jopla For You App on any mobile or desktop device by accessing it via their Internet address.

The Apps use techniques suitable for encrypting the material contained therein, safeguarding and preserving the User’s personal data.

The User cannot use the Services for illegal or unauthorized purposes. In this case, the Property reserves the right to deactivate the username and the connected service.

The User is solely responsible for information, data, photos sent to Jopla. The Property reserves the right, but not the obligation, to remove content and accounts that it deems to be illegal, offensive, defamatory, obscene and in violation of these contractual conditions.

The User may not in any way and for any reason decode, alter or modify the service offered through the Jopla Software.

The User is expressly prohibited from using automated systems aimed at sending messages to the Jopla server.

The conduct referred to in the previous points, even in terms of mere attempts, and those aimed also at violating the rights of copyrights, trademarks, and other intellectual property rights, or rights to the protection of personal data of third parties, are strictly prohibited and will constitute a serious breach of this contract.

The User is considered in any case unique and solely responsible for the use of the Jopla Software.

The Property reserves the right to suspend access to the service by the User as well as the right to report the User to the Authorities, in any competent office, in order to prevent the perpetuation of the aforementioned conduct and to protect your rights. The use of the Site and the App involves the processing of data by Jopla in compliance with the rules on the protection of personal data as per separate information ( Cookie-SDK Policy and Privacy Policy ).

ART. 7 – Modification of functions

The Property undertakes to keep the Site and the Jopla Apps active, error-free and safe.

The Property undertakes to maintain constant and regular operation of the service, however, it cannot guarantee it. The Property may make changes to the services or delete features at any time, possibly communicating any substantial changes to the User in advance.

ART. 8 – Registration conditions

The registration of an account by the Pro is mandatory to have access to the Services and features of the Jopla Pro App.

The registration of an account by the Customer will be necessary for the completion of the search and therefore before the creation of the list of useful results to draw from.

Account registration by the Customer is mandatory to have access to the Services and features of the Jopla For You App and to be able to continue and complete the selection process.

The User agrees to:

  • provide the personal information (“ Registration Data “) requested during this procedure, taking care that it is current, complete and truthful;
  • promptly update and constantly the Registration Data so that these are always current, complete and truthful.

If the User provides false, inaccurate, not current or incomplete information, or if Jopla believes, on the basis of its own discretionary assessment, that the information provided by the User is false, inaccurate, not current or incomplete, this Ultima will in any case have the right to deactivate, temporarily or permanently, the User’s account in question, preventing any subsequent use of the Service.

The User is required to keep account and password information confidential and is responsible for any activity carried out with their username.

At the end of the registration procedure, the User obtains the assignment of a personal Account which can be accessed via confidential User Identification ( ID ) and Password ( PW ) .

The Jopla Account is for strictly personal use.

The User is solely and exclusively responsible for the custody and correct use of the access credentials to his Account (this responsibility, obviously extended to any sort of activity that can be exercised through its use), and, therefore, undertakes to log in and log out correctly and carefully, to immediately notify Jopla of any unauthorized use of your Account, as well as any other breach of the security rules of which he becomes aware.

Jopla cannot in any way be held responsible for any damages deriving from non-compliance with these registration conditions, being the User aware that, in order to regulate access to the service, their authentication is left exclusively to verification of ID and PW.

The User is therefore responsible for any harmful consequence or prejudice that may arise, against Jopla or third parties, as a result of incorrect use, loss, theft and / or compromise of the confidentiality of ID and PW. < / p>

All the operations carried out through the User Account involve the automatic tracing back to the same of the operations carried out and the requests made according to these General Conditions, without exception.

Registration involves the processing of data by Jopla in compliance with the rules on the protection of personal data as per separate information ( Privacy Policy ).

ART. 9 – Duration of the user license

The user license has a duration of one year from its activation and upon expiration it will be tacitly renewed for a period of time of the same duration, unless terminated by Jopla with immediate effect. Registered Users can stop using the Application at any time and deactivate their account by requesting its cancellation through the Application interface.

CONDITIONS OF USE AND SALE OF JOPLA PRODUCTS AND SERVICES

ART. 10 – Description of the characteristics of the products and use of the services

Jopla offers a wide range of Products and Services (collectively “ Services” ) for Professionals looking for work and professional opportunities of various kinds.

These Services relate in particular to

  • the possibility to create a professional profile for free;
  • the right to emphasize one’s skills and work safely with suitable insurance coverage;
  • creation of new business contacts;
  • the use of integrated functions for the organization of one’s professional activity (calendar / messaging / lists), for the drafting of clear and transparent contracts and for the receipt of safe and secure payments ;
  • the possibility of obtaining reviews and in-depth analysis of one’s professional possibilities at the end of the job with suggestions and useful indications for improvement;
  • the possibility of participating in the Jopla Programs and, increasing the level loyalty, get professional benefits.

The features and integrated functions of the Services offered by Jopla and the specific methods of use are detailed within them.

ART. 11 – Free services included

The registration of the Pro account is free.

The following features are also free and included in the Basic Services for Pros:

  • professional analysis
  • professional damage and accident insurance

Jopla reserves the right to propose promotional offers during the contractual relationship for the benefit of the User in the manner specifically provided for.

ART. 12 – Methods of carrying out the research results

Jopla has developed a research system for professionals that allows a targeted and refined investigation according to predetermined criteria.

Based on the search criteria set by the client looking for a professional, the Jopla For You algorithm searches for compatible professionals using the following method:

Step1: circumscription of the search perimeter based on distance, rate and type of work

Step 2: sorting of the results obtained according to the following criteria:

  • Professional characteristics: reviews received (communication, friendliness, reliability, flexibility, competence, motivation, safety, profile), response time, cancellation rate, loyal customers, loyalty level, first aid training course , identity card loaded into the profile and verified by Jopla. Many of these criteria can be found in the Fidelity Program for Professionals, and are always visible, updated, described and known to the professional in the Jopla PRO App.
  • CO2 emissions from business travel
  • Client preferences

In order to encourage entry into the job market without discrimination of experience or rate, the Jopla search system always offers the client at the top of the list visibility of 3 new professionals (users for less than a month who have not yet performed jobs reviewed by Jopla clients) selected on the basis of distance from the workplace.

  • the ability to highlight one’s needs and to find suitable professionals and benefit from suitable insurance coverage;
  • the use of software for the creation of new business contacts;
  • the use of integrated functions for the organization of assigned tasks (calendar / messaging / lists), for the drafting of clear and transparent contracts and for making safe and secure payments;
  • the possibility to provide reviews after work and benefit from the reviews of other customers;
  • the possibility to participate in the Jopla Loyalty Program and, increasing the loyalty level, get benefits.

The features and integrated functions of the Services offered by Jopla and the specific methods of use are detailed within them.

ART. 14 – Free and included services

Customer account registration is free.

The following features are also free and included in the Basic Services for Customers:

  • creation of a personal profile
  • insertion of advertisements and preferences
  • unlimited search for Pros
  • compensation of CO2 impact

Jopla reserves the right to propose promotional offers during the contractual relationship for the benefit of the User in the manner specifically provided for.

ART. 15 – Paid services

Monthly or annual subscriptions are paid and can be activated at the request of the Customer through the integrated functionality, which include respectively:

  • CO2 impact compensation
  • access to exclusive discounts of the loyalty program

ANNUAL SUBSCRIPTION

120 EUR / year

Automatic monthly renewal and cancellation at any time

  • creation of personal profile

  • unlimited fast messaging for Pros
  • unlimited job offer to the Pros
  • consultancy and contract drafting

  • 10 EUR shopping voucher for each invited friend who has subscribed to the annual subscription

ART. 16 – Prices and payment methods

The prices are those indicated on the Site at the time of connection in the relevant section and calculated based on the type of subscription and quantity of Services chosen.

Jopla reserves the right to change prices at any time, but equally undertakes to apply the prices indicated on the Site at the time the order is placed.

Prices are quoted in Euros and do not include Italian VAT.

In case of use of the paid services offered by Jopla, the User will be asked to fill in the order form.

The automatic order registration systems serve as proof of the nature, content and date of the order. A confirmation of order acceptance with all product, price and activation specifications is sent to the e-mail address supplied by the User.

The order management costs, the amount of which is indicated before confirming the order, are highlighted separately and are part of the final sum.

The information communicated at the time of the order binds the User; in the event of a typing error, Jopla cannot be held responsible.

Payment is made online through a secure payment system, or by any other means mentioned on the Site.

Jopla reserves the right to cancel any order in the event of failure by the User to comply with these General Conditions.

Jopla reserves the right to propose promotional offers during the contractual relationship for the benefit of the User in the manner specifically provided for.

The User undertakes to comply with the promotional service in good faith and in compliance with these General Conditions. In case of illicit use of one or more Accounts also for the purpose of being able to take advantage of the same promotion several times, Jopla will have the right, at its sole discretion, to: (i) block one or more Accounts, also pursuant to and for the purposes of subsequent article 12; and / or (ii) cancel one or more Accounts.

COMMON PROVISIONS

ART. 17 – Requirements for the use of the site and the App

The Jopla Apps, as well as all Services and Products are reserved for individuals aged 18 and over.

ART. 18 – Suitability for the use of the site, the App and the services

By requesting the use, registering for the use and / or use of the Apps or Services, the User declares and guarantees to have the right, authority and ability to enter into these General Conditions and undertakes to comply with all the terms and conditions of this document. Furthermore, he declares and guarantees to satisfy the following eligibility criteria, namely that:

  • intends to use the Apps and Services exclusively for the purpose of finding or managing the assignment of professional assignments or works relating to the areas indicated, or to find or share information relating to services performed.
  • is authorized to work legally in the country of origin or destination of the work.
  • has never been the subject of conviction, arrest, charge, complaint, restraining order or any other legal action involving any crime, or any other offense involving violence, physical, sexual or emotional abuse, or any crime, violation or wrongful act that endangers the safety of others.
  • is not registered, or currently required to register, as sex offender at any government agency.
  • is not a competitor of Jopla or uses the Services for reasons in competition with Jopla.

In the case of a consumer user, meaning the natural person who makes the purchase for purposes not related to any commercial or professional activity carried out, the provisions of the Consumer Code, Legislative Decree no. 206/2005 subsequent amendments and additions.

ART. 19 – User responsibility

Registered users are solely responsible for the interview, screening, carrying out background checks and references, verifying the information provided and selecting a client or professional appropriate for themselves, their family or company, the organization of the work performance, as well as the payments of the related fees. Each User is responsible for complying with all applicable employment laws and other laws in relation to any employment relationship they establish, including verifying the age of the Professional they select, as well as the eligibility of such Professional to work in the country of destination of the service.

ART. 20 – Duration, execution and renewal

Subscriptions have a fixed duration (1 month, 1 year, etc.).

The User has the right to choose the duration by opting for the chosen period directly at the time of subscription.

The execution of the subscription is immediate following activation of the chosen subscription formula.

All paid subscriptions and recurring paid services or products will continue indefinitely until terminated by the User.

In the absence of cancellation, the contract is automatically renewed upon expiry, for an equal period of time.

The subscription will be renewed automatically at the end of the chosen period for a further period equivalent to the subscription rate and frequency communicated on the site at the time of initial subscription, unless otherwise indicated by the renewal User for a higher subscription period .

The termination of the paid subscription can be exercised at any time prior to the day of renewal, by following the instructions on the Profile page. If you cancel a paid subscription, you will be allowed to use the subscription until the end of the current subscription period. The paid subscription will not be renewed after the current term expires, and no early termination fees will be charged.

ART. 21 – Right of withdrawal

Pursuant to Article 49, paragraph 4, Legislative Decree no. 206/2005 (Consumer Code), the right to withdraw from the contract is guaranteed, without giving any reason, within 14 days.

In case of purchase of a digital subscription, the withdrawal period expires after 14 days from the activation date of the purchased subscription.

To exercise the right of withdrawal, the User must communicate to Jopla the desire to withdraw from the contract by means of an explicit declaration sent by registered letter with return notice to the following address:

Subject: Notice of Withdrawal

Hereby, I, the undersigned _____, born in _____, resident in _____ Via _____ n. ___, Tax Code _____, I intend to formally withdraw from the contract _____ with you stipulated on _____, concerning the digital subscription to the Jopla Services. I also ask for the return of the payment made in execution of the contract.

To meet the withdrawal deadline, it is sufficient that the communication relating to the exercise of the right of withdrawal is sent before the withdrawal period has expired.

In case of regular exercise of the right of withdrawal, the payments made in favor of Jopla will be reimbursed, no later than 14 days from the day of receipt of the notice of withdrawal.

These refunds will be made using the same payment method used for the initial transaction.

Upon receipt of the notification within the terms, Jopla will disable the subscription, and will refund the amount paid.

The User acknowledges that – since it is a digital subscription and considering the intangible nature of the purchased product – pursuant to Article 59, 1, letter a) and o) of the Consumer Code “the right of withdrawal pursuant to articles . from 52 to 58 for distance contracts and contracts negotiated away from business premises is excluded in relation to: a) service contracts after the complete provision of the service if the execution has begun with the express agreement of the consumer and with the acceptance of the loss of the right of withdrawal following the full execution of the contract by the professional; o) the supply of digital content through a non-material support if the execution began with the express agreement of the consumer and with his acceptance of the fact that in this case he would have lost the right of withdrawal “.

It should be noted that by accepting these General Conditions, the User agrees to the immediate execution of the contract and is aware that the right of withdrawal from the contract will cease once the services and digital content have been used. Therefore, in accordance with article 591, letters a) and o) of the Consumer Code, the User expressly renounces the exercise of the right of withdrawal in the event that the service is performed immediately and / or performed before the end of the date. of withdrawal (by way of example and not exhaustive: exchange of messages with professionals, job offers, questions or creation of professional collaborations etc.)

ART. 22 – Third party suppliers

Jopla may use third party suppliers for the provision of some of its services and integrated features.

The suppliers will always be indicated in a clear and transparent manner by means of a specific indication in the respective Services.

Below is the current list of permanent direct suppliers:

  • Stripe for integrated payment and tracking functionality
  • Helvetia and Chubb for insurance services
  • Myclimate for measuring and offsetting CO2 emissions

ART. 23 – Copyright, database rights, trademarks and patents

The user accepts and acknowledges that the Site and the Jopla Apps, which include, by way of example, texts, graphics, editorial content, logos, icon buttons, images, audio and video files, digital downloads, data collections and software are the property of Jopla and contain proprietary information and material owned by Jopla and are protected by intellectual property regulations, and other applicable provisions, including, by way of example, copyright.

The graphic material, logos, page headers, icon buttons, characters and service marks included or made available through the Site, the Apps or any of the Jopla Services are trademarks or distinctive signs of Jopla.

Jopla’s trademarks and distinctive signs may not be used in connection with products or services other than Jopla, in such a way as to create confusion among users or in any way that could denigrate or discredit Jopla.

All other non-Jopla trademarks that appear on any of the Jopla Services are the property of their respective owners, who may or may not be related, connected to Jopla or sponsored by Jopla.

The Jopla Services and the functionalities accessible through these services are protected by one or more patents owned by Jopla.

The assets listed above are protected by the rules on intellectual property, copyright and database rights, the Industrial Property Code, the Civil Code and the Criminal Code and any applicable provision.

The user agrees to use such information covered by copyright and materials exclusively for the use of the Site and the Apps in compliance with the provisions of this contract.

It is not allowed to systematically extract and / or reuse parts of the Jopla Services without Jopla’s express written consent. In particular, it is not allowed to use data mining, robots or similar acquisition or extraction devices to extract (one or more times) to reuse any substantial part of the Site or the Jopla Apps or any of the connected Services without your express written consent. Nor is it permitted to create and / or publish your own database that reproduces substantial parts (e.g. prices and product lists) of the Jopla Services without Jopla’s express written consent.

It is not possible to reproduce, duplicate, copy, sell, resell, visit or in any other way use the Jopla Services for any commercial use in whole or in part without your express written consent.

You may not framing or use framing techniques to misappropriate any Jopla trademark, logo or other proprietary information (including images, text, page settings, or formats) of Jopla, or use any meta tags or any other “hidden text” using Jopla’s name or trademarks, in the absence of express written consent.

The Property is the exclusive owner, on the national and international territory, of the “Jopla” service, of the logo, of the interactive functions, of the design, of the script and of the graphics.

No part of the Site, the App or any of the Jopla Services may be reproduced in any form or by any means, except as expressly permitted in these conditions.

The user agrees not to modify, rent, rent, lend, sell, distribute or create derivative works based on the Site, the Apps or the Jopla Services, in any way, and will not be able to exploit the application in an unauthorized manner. .

Despite what is otherwise provided in this contract, Jopla reserves the right to change, suspend, remove or disable access to the application without notice.

Under no circumstances will Jopla be responsible for these changes. Jopla may also impose limits on the use or access to certain features or parts of the service, in any case and without notice or liability.

ART. 24 – Digital content and related intellectual property

The digital content provided by the User is retained by Jopla exclusively for the use of the Services.

Jopla has no right to control or intervene on the digital content forwarded by the User which, therefore, cannot be verified or modified in any way.

The processing of digital content provided by the User and the cancellation of the same take place in full compliance with the legislation on the protection of personal data and with the adoption of all measures to avoid any abuse, accidental or intentional manipulation or access by unauthorized persons.

The User acknowledges that all information, photographs, images and all files (“ Contents “) transmitted by him fall within the sole and exclusive responsibility of the persons from whom such Contents originate. : it being understood that the User, and not Jopla, is solely and exclusively responsible for any Content sent or transmitted or disseminated through the Jopla Apps.

The Property cannot in any way control the Contents transmitted and / or disseminated through the Site or the Jopla Apps and consequently does not guarantee their lawfulness, truthfulness, correctness and quality.

The User undertakes not to use the Site or the Jopla Apps to: (1) send or transmit in any way Contents that are illegal, harmful, threatening, abusive, harassing, defamatory and / or libelous, vulgar, obscene , harmful to the privacy of others, racist, classist or otherwise reprehensible; (2) harm minors in any way; (3) send or transmit or disseminate in any way, a Content that is forbidden to transmit or disseminate by virtue of a provision of law, contract or as a result of a relationship of trust; (4) carry out framing activities; (5) send or transmit or disseminate in any way a Content that involves the infringement of patents, trademarks, secrets, copyrights or other industrial and / or intellectual property rights of third parties; (6) send or transmit or disseminate in any way, any material that contains viruses or other codes, files or programs created to interrupt, to destroy or to limit the functioning of the software, hardware or telecommunications systems of third parties; (7) interfere with or interrupt the Apps, servers or networks connected to the Service, act in conflict with any requirement, procedure or rule of the networks connected with the Service; (8) violate, intentionally or unintentionally, any applicable law or regulation.

The User acknowledges that Jopla does not check the Contents in advance, however it is not able to do so.

In order to guarantee Users the truthfulness of the information transmitted, Jopla carries out a profile verification system. This check consists in verifying the identity of the professionals who apply for verification of their profile.

  • Identity: the User electronically transmits a copy of his valid identity document (identity card, passport). Jopla verifies the agreement of the name, surname, and age transmitted during registration on the Platform;

However, Jopla and the subjects designated by it reserve the discretionary right – without assuming any obligation in this regard – to refuse or remove any Content accessible through the Apps.

Jopla and the subjects designated by her reserve the right to remove any Content that constitutes a violation of these General Conditions.

The User undertakes to fully and independently assess, assuming all the risks, the extent of any content, in particular renouncing, always and in any case, any complaint for the case of compromising the trust placed by him on the truthfulness , completeness or usefulness of the various Contents.

The User acknowledges and accepts that Jopla has the right to store the Contents and to disclose them to third parties for the following purposes: a) to companies connected to it, to allow the Website and Apps to function properly and to provide the Service to the User efficiently and in order to administer the User Account in accordance with the envisaged operating procedures; b) in the cases provided for by law or if Jopla deems it necessary and / or appropriate to: (i) fulfill legal procedures; (ii) apply the General Conditions; (iii) respond to complaints from third parties for violation of their rights; (iv) protect the rights, property or security requirements of Jopla, its users and third parties.

The User agrees and agrees that the technical processing, transmission or dissemination of the Service, including its Contents, may involve:

  • the transmission or dissemination of the Contents on (or through) other networks, with the sole purpose of improving the visibility of job searches on search engines, and never sharing Contents in exchange for an economic consideration;

The User remains the owner of any Content transmitted and guarantees to Jopla that no intellectual property rights, trademark rights, or any other rights belonging to third parties are not subject to counterfeiting or infringement.

ART. 25 – Legal guarantee and conformity

Jopla guarantees that the Site, the Apps and the related Services comply with their description and the contract, that they are suitable for the use they serve and that they have the qualities of goods and services of the same type. ART. 26 – Limitation of liability

The User acknowledges and expressly declares that:

  • the use of the Site and the Jopla Apps takes place at its sole discretion and under its own responsibility;
  • the Site and the Apps are provided in the version available at that particular time; < / li>
  • Jopla assumes no responsibility for use, availability, punctuality, cancellation, non-delivery, updating, absence of defects and correction, quality and compatibility of the service for a specific use, or compliance with the rules of use of the service by users; no advice and no information, oral or written, obtained from Jopla or during the use of the service may create guarantees not expressly provided for in the General Conditions.
  • all materials downloaded or obtained in any other way during the use of one of the services under its own responsibility.
  • Jopla does not guarantee the uninterrupted performance of the Site and the Apps, nor any damage suffered by the equipment (computer or mobile device) or any loss of data following the download of the material.

The User undertakes to indemnify Jopla against any damage, complaint or request from third parties resulting from (i) the sending, dissemination, use or transmission of content by the User, (ii) the use of the Site and the Apps and related Services, (iii) the violation of the General Conditions, or (iv) the violation of the rights of others. This guarantee is extended to the claimed indemnities, lawyers’ fees and court costs.

The User acknowledges and accepts that, to the extent permitted by the regulations in force, Jopla cannot be held responsible for any direct or indirect damage, including loss of profit, of the User, of data or any other loss of goods. material or immaterial (and this even if Jopla has been informed of the potential of such damages) that may derive (i) from the use or on the contrary from the impossibility of use of the Site, the Apps and the Services, (ii) from the acquisition of goods or a transaction made while using the Site, Apps or Services, (iii) following unauthorized access to the Site, Apps or one of the Services by the User and, (iv) more generally, from any other matter in connection with the Site or the Jopla Apps.

ART. 27 – Express termination clause

The violation of these General Conditions will result in the revocation of the authorization or license issued by Jopla.

The violation of the obligations by the User will result in the legal termination of this contract subject to the company’s right to appeal to the Judicial Authority for compensation for damages. Access to the Site or Apps and Services will be disabled and therefore it will no longer be possible to access and use them or any content created through them.

ART. 28 – Account deactivation

Jopla has full right to deactivate or delete the User Account or interrupt access to the Site or Apps, or remove, move or refuse the dissemination of Content within the Site or the Apps for any reason, in particular: (i) due to the absence of use of the Account for the duration of twelve months, (ii) if Jopla has legitimate reasons to consider that the User has violated or acted in contradiction with the General Conditions and (iii) in case of behavior considered by Jopla as harmful to other users, to Jopla’s activity, or to third parties.

Any measure taken by Jopla in relation to the Account and the right of access to the Service by the User can intervene immediately and in the absence of a prior warning, without any responsibility being attributed to Jopla in relation to it . In case of illicit use of one or more Accounts also for the purpose of being able to take advantage of the same promotion several times, to alter or modify search criteria and / or offer to professionals, Jopla will have the right, at its sole discretion, to: ( i) block one or more Accounts and / or (ii) cancel one or more Accounts.

ART. 29 – Communications

Any communication between the parties must be done by e-mail. Jopla will be able to make communications regarding changes to these General Conditions also by posting direct notices to users on the Site or in the App.

ART. 30 – Applicable law and competent court

These General Conditions and the relations between Jopla and the User are governed by the law of the Italian Republic.

For any dispute concerning, deriving from or in any case connected to these General Conditions or to the use of the Service, the Court of Rimini will be competent, excluding any other, or, in the case of a consumer User, the competent Court will be determined pursuant to art. 66 bis of the Consumer Code.

This agreement is drawn up in Italian and will prevail, in the event of a conflict, over any previous versions and / or further versions translated into foreign languages.

Considering the global nature of the Internet, the User undertakes to comply with all the rules relating to the behavior of users of the network, the admissible content and the applicable laws regarding data transmission, the quality of content and work, applicable in the country where it is located.

ART. 31 – Various

These General Conditions constitute the only and exclusive agreement between the User and Jopla: these prevail over any possible agreement previously reached between the aforementioned subjects.

The User must also comply with any General Conditions relating to the use of complementary services or services related to third-party content or relating to the rules of use of third-party software.

Failure by Jopla to exercise its right provided for by law or by these General Conditions does not in any case constitute a waiver of the right itself.

It is understood that, should one or more provisions of these General Conditions be declared invalid by the competent Judge, the effectiveness of the additional clauses, as set out above, as well as of the other General Conditions above must in any case remain binding.
